Privacy Policy
Jensen McConaghy respects the privacy of individuals and their Personal and Sensitive Information. This Policy explains how Jensen McConaghy deals with Personal and Sensitive Information that is collected in the course of its business. Jensen McConaghy is an Organisation for the purposes of the Privacy Act (Cth) and complies with the provisions of that Act, including the National Privacy Principles.
COLLECTION OF YOUR INFORMATION
We collect your personal information for the primary purpose of providing legal advice and services, including but not limited to training, consulting and associated advice and service to our clients and others. We may collect your sensitive information if we have obtained your consent, and the information is reasonably necessary for the provision of our services. We may also collect such information in other circumstances, as permitted by the Privacy Act.
THIRD PARTIES
Where reasonable and practicable to do so, we will collect your personal information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
USE AND DISCLOSURE OF INFORMATION
We may use or disclose your personal information with third parties including our clients, your professional advisers, and organisations with whom we have co-promotional arrangements (and any third parties used in administering those arrangements).
We may also use or disclose your personal information with other service providers including organisations that assist us by providing archival, auditing, consulting, delivery, technology and security services.
In addition, we may use or disclose your personal information:
- For the purposes for which it was collected;
- Where you have consented to the use or disclosure;
- To maintain our relationship with you;
- For research, planning, service development, security and risk management;
- Where a third party acquires or wishes to acquire, or makes inquiries in relation to acquiring, an interest in Jensen McConaghy, or
- To the extent that we are required or authorised by law to do so.
We may also use your personal information to keep you informed of our services, events, developments in the law and other related matters. If you do not wish to be contacted for those purposes, please let us know.
We may use or disclose your sensitive information for the purposes of providing our services/primary purpose. We may also use or disclose your sensitive information for secondary purposes which are directly related to the provision of our services/primary purpose, or when otherwise permitted by the Privacy Act.
DATA SECURITY
We use several mechanisms to protect the security and integrity of your personal information. Unfortunately, no information system can be guaranteed as completely secure. Although we take all reasonable care to protect such information, we do not ensure or warrant the security of any information that we collect, or you transmit to us, or that we store on your behalf. Once any personal information comes into our possession, we will take reasonable steps to protect that information from misuse, loss, unauthorised access, modification or disclosure.
Once our primary purpose has been completed, and the personal information is no longer required, we will take all reasonable steps in the circumstances to destroy the information or to ensure that the information is de-identified. In this regard, we note that we will generally retain such documents for a period of 7 years after the conclusion of a matter in accordance with Australian Solicitors Conduct Rules 14.2, after which time they will be destroyed.
ACCESS TO INFORMATION
You may access the personal information we hold about you and to update and/correct it, subject to certain exceptions. If you wish to request access to personal information which we hold about you as a result of our information collection practices, please contact us.
In dealing with a request to access personal information, we will maintain any legal or equitable right which may apply for the benefit of us or our clients, including any claim to privilege that may attach to the information. In addition, we will rely on the national privacy principles.
MAINTAINING THE QUALITY OF YOUR PERSONAL INFORMATION
We will take reasonable steps to ensure that your personal information is accurate, complete and up to date. If you find that information we have is not up to date or is inaccurate, please advise us as soon as practicable.
